Obligation to use a respirator or similar protective equipment in selected areas

The Ministry of Health issued an extraordinary measure on 22.02.2021 (you can find it in this link), which prohibits movement and residence without respiratory protective devices (nose, mouth), which is a respirator or similar device (always without exhalation valve) meeting at least all technical conditions and requirements, including filtration efficiency of at least 95% according to relevant standards (eg FFP2 / KN 95) or two superimposed medical face masks or similar devices meeting at least all technical conditions and requirements of ČSN EN 14683 + AC, which prevents the spread of droplets, namely (excluding especially for our faculty needs):

(a) in the interiors of buildings which serve as:

  • (i) shop,
  • (ii) a service establishment,
  • (iii) medical facilities, in workplaces where outpatient care is provided,
  • (iv) social services facilities, such as weekly hospitals, homes for the disabled, homes for the elderly and homes with special arrangements, and facilities providing relief social services in residential form,
  • (v) international airports,

b) public transport,

c) on the platform, in the shelter and waiting room of public transport,

(d) in motor vehicles, unless there are only persons from one household in the motor vehicle.

 

The Ministry also prohibits movement and residence without respiratory protective equipment (nose, mouth), which is a respirator or similar device (always without exhalation valve) meeting at least all technical conditions and requirements (for the product), including filtration efficiency of at least 95% according to relevant standards (eg FFP2 / KN 95), medical face mask or similar device meeting at least all technical conditions and requirements (for the product) of the ČSN EN 14683 + AC standard, which prevent the spread of droplets, namely:

a) in all interiors of buildings, outside the residence or place of accommodation (eg hotel room),

b) in all other publicly accessible places in the built-up area of ​​the municipality, where at least 2 persons less than 2 meters apart are present at the same place and at the same time, unless they are exclusively household members.

In exceptional cases, where it is necessary for a pupil or student to see the teacher's mouth during instruction, it is possible for the teacher to use a protective shield as a respiratory protective device, provided that he maintains a distance of at least 2 meters from pupils or students.

In the period up to 28. 02.2021, another protective device that prevents the spread of droplets can be used instead of the protective device specified in this way.

 

The ban does not apply (we choose for our faculty needs) to:

b) children in kindergarten and children in a children's group,

c) pupils, students and pedagogical staff pursuant to the Education Act and students and academic staff pursuant to Act No. 111/1998 Coll., on Higher Education Institutions and on Amendments to Other Acts (Act on Higher Education Institutions), as amended, within the activities the nature of which does not allow the wearing of a protective equipment (especially physical training, singing, playing wind instruments),

n) employees and persons in a similar position, including constitutional officials, for the period when they perform work in one place, if such a person works at a distance of at least 2 meters from another person,

x) Athlete or Trainer:

  • during training, exercises, matches, competitions, etc. in outdoor areas,
  • indoors and outdoors, in the case of persons during sports activities and preparation for them held within the framework of competitions organized by sports associations, if they perform these sports activities within the scope of employment, business or other similar activities; this similarly applies to persons of coaches and referees participating in these activities,

y) persons in the premises of indoor artificial swimming pools, which are a swimming pool, etc.
